Mahasiswa dan aktivis Greenpeace bersama Gregorius Yame dari Masyarakat Asli Papua Suku Awyu (kiri) bersolidaritas saat menghadiri sidang kasus pencabutan izin kawasan hutan di Pengadilan Tata Usaha Negara (PTUN), Jakarta. Hendrikus Frangky Woro dan Gregorius Yame menjadi saksi bagi terdakwa terkait gugatan yang diajukan dua perusahaan perkebunan kelapa sawit di kawasan Boven Digoel, PT. Kartika Cipta Pratama (KCP) dan PT. Megakarya Jaya Raya (MJR) melawan Kementerian Lingkungan Hidup dan Kehutanan (KLHK) atas Pencabutan Izin Kawasan Hutan, Selasa (05/09/2023). – Bumiofinavandu/Dok Greenpeace Indonesia.

Jayapura, Bumiofinavandu –  Tujuh bulan setelah Pejuang lingkungan hidup dari Suku Awyu, Hendrikus ‘Franky’ Woro melayangkan gugatan lingkungan hidup dan perubahan iklim ke Pengadilan Tata Usaha Negara (PTUN) Jayapura kini memasuki fase mendengarkan pendapat ahli. Hadir dalam persidangan pada Kamis, (05/10/2023) yakni Dr. Totok Dwi Diantoro, salah satu ahli hukum lingkungan dari Fakultas Hukum Universitas Gadjah Mada.

Gugatan dengan Nomor Perkara 6/G/LH/2023/PTUN.JPR menyangkut izin lingkungan hidup yang dikeluarkan Dinas Penanaman Modal dan Pelayanan Terbuka Satu Pintu Provinsi Papua untuk perusahaan sawit PT Indo Asiana Lestari (PT IAL). Franky merupakan pemimpin marga Woro–bagian dari Suku Awyu, sebagai pemilik wilayah adat tidak mendapatkan informasi tentang rencana aktivitas perusahaan. Kami juga tidak dilibatkan saat penyusunan analisis mengenai dampak lingkungan (Amdal).

Hutan dan tanah adat merupakan lebensraum atau ruang hidup bagi masyarakat adat. Oleh karenanya partisipasi publik jadi penting untuk dipastikan dalam setiap proyek pembangunan. Sebelum menerbitkan keputusan, Pejabat Tata Usaha Negara harus menerapkan asas kehati-hatian dan partisipasi bermakna. Partisipasi tidak hanya didengar tetapi hingga dipertimbangan dalam pengambilan keputusan.

Ahli menjelaskan, AMDAL merupakan kajian, studi ilmiah yang dijadikan referensi dalam pengambilan keputusan. Amdal adalah bagian dari prosedur dalam perizinan. Sebagai dokumen ilmiah maka diperlukan kejujuran dan objektivitas dalam proses penyusunan analisis dampak lingkungan (AMDAL), dapat terjadi peluang amdal bermasalah jika dilakukan dengan manipulasi data maka konsekuensinya legalitas amdal tidak sah. “Dalam prinsip kehati-hatian, Pejabat Tata Usaha Negara wajib dengan cermat dan bijaksana terhadap proses dan kajian AMDAL yang telah dibuat karena dalam proses amdal itu masih ada kemungkinan keliru,” ujar Totok Dwi Diantoro.

Ahli juga menjelaskan FPIC atau persetujuan awal tanpa paksaan merupakan hak asasi masyarakat adat yang berkaitan dengan masyarakat adat, sebelum izin diberikan maka pemberian informasi hingga persetujuan harus didapatkan terlebih dahulu. Jika hal ini tidak dilakukan maka terjadi pelanggaran terhadap hak masyarakat adat. Termasuk memperhatikan kebijakan internasional yang telah diadopsi indonesia dalam mengatasi krisis iklim, pemerintah harusnya memasukan instrumen ini dalam AMDAL.

dilanjutkan dengan agenda kesimpulan pada tanggal 19 Oktober 2023 secara E court, setelah itu majelis hakim akan mengambil keputusan.

Dalam sidang ini Gerakan Solidaritas Untuk Selamatkan Hutan Adat Papua mengirimkan surat dukungan yang ditujukan kepada majelis hakim, surat ini berisi dukungan dari 73 lembaga dan
