Nabire, BumiofiNavandu – Dua permohonan perkara sengketa pemilihan kepala daerah (pemilukada) Nabire tahun 2020, telah di sidangkan oleh Mahkamah Konstitusi atau MA pada Jumat (19/03/2021), dan dibacakan oleh MK, di panel dua.
Dua perkara pemilikada Nabire tersebut adalah permohonan perkara Nomor 84/PHP.BUP-XIX/2021 yang diajukan Fransiscus Xaverius dan Tabroni bin M Cahya, dan permohonan perkara Nomor 101/PHP.BUP-XIX/2021 yang diajukan paslon Yufinia Mote dan Muhammad Darwis.
Hasilnya, MK memerintahkan kepada KPU Nabire untuk menggelar Pemungutan Suara Ulang (PSU) pemilihan Bupati dan Wakil Bupati di seluruh Nabire, Papua. sebab dinilai pilbup Nabire digelar dengan me ggunakan sistem noken dan bukan sistem coblos langsung.
“Memerintahkan kepada KPU Kabupaten Nabire untuk melaksanakan PSU Pemilihan Bupati dan Wakil Bupati Nabire,” Ujar Ketua MK Anwar Usman dalam sidang terbuka yang disiarkan di channel YouTube MK, pada Jumat (19/03/2021) petang.
MK lanjut Anwar Usman, jugga memerintahkan PSU berdasarkan Daftar Pemilih Tetap (DPT), yang diperbaiki sesuai ketentuan peraturan perundang-undangan serta melaksanakan dengan sistem pencoblosan langsung. Dan Hasil pemungutan suara ulang itu harus dilaporkan kembali kepada MK.
“Memerintahkan pemungutan suara ulang itu maksimal 90 hari sejak putusan ini dibacakan,” lanjutnya.
Mahkamak Konstisuti juga memerintahkan kepada KPU dan Bawaslu untuk melakukan supervisi atas penyelenggaraan PSU. MK juga memerintahkan Polri dan jajaran untuk mengawal proses PSU tersebut.
“Memerintahkan kepada Polri beserta jajarannya, khususnya Polres Nabire dan Polda Papua untuk melakukan pengamanan dan pelaksanaan Putusan Mahkamah ini sesuai dengan kewenangannya,” ungkapnya.
Majelis Hakim berbendapat, PSU perlu dilakukan lantaran ditemukan sistem Noken. Padahal Kabupaten Nabire tidak termasuk dalam Kabupaten yang pemungutan suaranya menggunakan sistem noken.
“Sebagaimana berdasarkan Keputusan KPU Papua Nomor 98/PL.02.6-Kpt/91/Prov/XI/2020,” ujarnya.
Sengketa pilkada Nabire Tahun 2020 bermula ketika KPU Nabire memutuskan paslon nomor urut 01 atas nama Yufinia Mote dan Muhammad Darwis, memperoleh 61.423 suara. Paslon nomor urut 02 atas naman Mesak Magai dan Ismail Djamaludin, memperoleh 61.729 suara, sekaligus ditetepkan sebagai paslon dengan perolehan suara terbanyak. Dan paslon nomor urut 03 atas nama Fransiscus Xaverius dan Tabroni Bin M Cahya memperoleh 46.224 suara.
