Manado, Bumiofinavandu –   Pejuang lingkungan hidup dari Suku Awyu, Hendrikus Franky Woro, melayangkan banding atas gugatan lingkungan hidup dan perubahan iklim ke Pengadilan Tinggi Tata Usaha Negara (PTTUN) Manado pada (22/11/2023).

Gugatan banding ini dilakukan setelah Majelis Hakim PTUN Jakarta menolak gugatan yang menyangkut izin lingkungan hidup yang dikeluarkan Dinas Penanaman Modal dan Pelayanan Terbuka Satu Pintu Provinsi Papua, untuk perusahaan sawit PT Indo Asiana Lestari (PT IAL).

Upaya banding ini dilakukan agar hakim memperbaiki putusan hakim PTUN Jayapura.

“Kami menilai, Majelis Hakim PTUN Jayapura salah dalam menerapkan pertimbangan-pertimbangan putusan,” ujar Tigor Hutapea, salah satu kuasa hukum Masyarakat Suku Awyu, melalui rilis yang diterima Bumiofinavandu.

Dibandingkan putusan-putusan lingkungan lainnya, menurut Tigor, putusan PTUN Jayapura tidak menggambarkan perlindungan terhadap lingkungan dan keberadaan masyarakat adat.

“Kami yakin Hakim Pengadilan Tinggi PTUN Manado akan lebih bijaksana memutus permohonan banding ini’ dengan berpedoman pada peraturan yang benar,” tuturnya.

Upaya banding tersebut dilakukan atas keyakinan bahwa PTUN Jayapura sebagai judex facti tingkat pertama telah salah menerapkan hukum, antara lain tentang: batas waktu gugatan, aspek prosedur dan substansi perkara pasca Peraturan Mahkamah Agung Nomor 1 Tahun 2023 tentang Pedoman Mengadili Perkara Lingkungan Hidup (Perma 1/2023), tidak mempertimbangkan fakta hukum bahwa Prosedur Pengumuman Objek Sengketa Bertentangan dengan Pasal 50 Ayat 3 PP Nomor 22 Tahun 2021 dan kesalahan dalam memberipertimbangan terkait partisipasi publik.

Tigor mengungkapkan, lebih jauh sesuai kerangka asas umum pemerintahan yang baik, Hakim PTUN Jayapura luput menganalisis fakta bahwa objek sengketa juga bertentangan asas kearifan lokal, asas kelestarian dan keberlanjutan, keserasian dan keseimbangan, kehati-hatian, ekoregion, keanekaragaman hayati, asas tertib penyelenggara negara, asas Kehati-hatian, asas keadilan, serta asas kemanfaatan.

“Putusan ini yang jelas-jelas melanggar hak masyarakat adat yang dijamin pada UUD 1945, UU Nomor 39 Tahun 1999 tentang Hak Asasi Manusia dan UU Nomor 2 Tahun 2021 tentang Undang Undang Nomor 21 Tahun 2001 Tentang Otonomi Khusus Bagi Provinsi Papua yang dilakukan dengan cara menggunakan Surat LMA dan mengabaikan Fakta Hukum Penolakan yang dilakukan oleh Pimpinan Marga Woro,” ungkapnya.

Kuasa hukum lainnya, Emanuel Gobay menambahkan, atas dasar itu, harapannya melalui Upaya Banding ini Majelis Hakim Pemeriksa di PT TUN Manado.

“Agar nantinya,  dapat menegakkan Hak Masyarakat Adat Papua melalui putusan yang berprinsip pada dasar perlindungan hak masyarakat adat demi memberikan kepastian hukum bagi penerus Marga Woro yang akan mewarisi Hak Atas Tanah dan Hutan di atas Wilayah Adat Marga Woro,” tambah Gobay.

Kuasa Hukum lainnya, Asep Komarudin juga mengingatkan bahwa pentingnya bagi publik untuk mengawal perkara ini bersama – sama dan Mahkamah Agung. Mengingat perkara ini bukan hanya permasalahan Administratif belaka, tapi ada Hak Masyarakat Adat yang dirampas, bahkan tidak diakui keberadaannya serta potensi dampak terhadap Iklim jika perusahaan.

Sebab perusahaan telah melakukan pembukaan lahan yang akan melepaskan setidaknya 23 Juta Ton CO2 yang bertentangan dengan komitmen pemerintah Indonesia dalam mengatasi krisis iklim.

“Bersamaan dengan pengajuan banding dari Hendrikus ‘Franky’ Woro, dua penggugat intervensi yakni Yayasan Pusaka Bentala Rakyat dan Walhi Eksekutif Nasional, juga mengajukan banding atas keputusan Putusan Pengadilan Tata Usaha Negara Jayapura Nomor 6/G/LH/2023/PTUN.JPR yang telah mengabaikan prinsip in dubio pro natura, yang bermakna.

“Jika hakim mengalami keragu-raguan mengenai bukti, maka hakim mengedepankan perlindungan lingkungan dalam putusannya’–demi kelanjutan hutan Papua yang menjadi sumber kehidupan masyarakat adat Papua,” pungkasnya.
