Nabire, Bumiofinavandu – Penjabat Gubernur Papua Tengah, Dr. Ribka Haluk, mengaktifkan kembali Wakil Bupati Mimika Johannes Rettob. Pengaktifan itu dilakukan karena Johannes Rettob dinyatakan tidak bersalah berdasarkan putusan pengadilan tindak pidana korupsi pada Pengadilan Negeri Jayapura pada tanggal 17 Oktober 2023.
“Berdasarkan Pasal 84 ayat (1) ”Kepala Daerah dan/atau Wakil Kepala Daerah yang diberhentikan sementara sebagaimana dimaksud dalam Pasal 83 ayat (1), setelah melalui proses peradilan ternyata terbukti tidak bersalah berdasarkan putusan pengadilan, paling lambat 30 hari terhitung sejak diterimanya pemberitahuan putusan pengadilan, maka Menteri mengaktifkan kembali Bupati dan/atau Wakil Bupati atau Wali Kota dan/atau Wakil Wali Kota yang bersangkutan,” ungkap Dr Ribka Haluk pada sambutannya, Selasa (21/11/2023).
Ribka Haluk membeberkan ketentuan hukum dan peraturan perundang-undangan tersebut menjadi dasar hukum untuk mengaktifkan kembali Johannes Rettob sebagai Wakil Bupati Mimika masa jabatan 2019-2024.
“Proses yang telah berlangsung ini merupakan bagian dari penegasan supremasi hukum di Negara Republik Indonesia. Kepada unsur Forkopimda, pimpinan dan anggota DPRD Kabupaten Mimika, serta tokoh masyarakat, bahwa terhitung mulai hari ini Johannes Rettob telah resmi diaktifkan kembali sebagai Wakil Bupati Mimika. Maka, hal-hal yang berkaitan dengan urusan pemerintahan, pembangunan dan kemasyarakatan kembali dapat dikoordinasikan dengan Wakil Bupati,” tegasnya.
Ribka Haluk menyampaikan kepada Johannes Rettob, atas nama Menteri Dalam Negeri dan Pemerintah Provinsi Papua Tengah mengucapkan selamat bertugas kembali sebagai Wakil Bupati Mimika. Namun ia mengingatkan kepada pemerintah Kabupaten Mimika untuk melakukan program prioritas nasional yang harus segera dilaksanakan.
“Agenda kedepan yang harus dikerjakan yakni persiapan penyelenggaraan pemilu tahun 2024 (kesiapan anggaran untuk KPU, Bawaslu dan pengamanan NI/Polri, utamanya pengamanan pemilukada. Memang saya sudah menerima laporan bahwa dari sisi anggaran Kabupaten Mimika sudah menganggarkannya 100 persen bahkan lebih, ini menjadi apresiasi bagi kami dan hal ini harus menjadi contoh bagi daerah lain di Prov Papua Tengah,” tuturnya.
Agenda lainnya, ungkap Ribka Haluk yakni upaya penghapusan kemiskinan ekstrem target nasional maksimal sebesar 13%. Kemudian penanganan stunting menuju 0% (nol persen) pada tahun 2024 serta pengendalian inflasi daerah.
“Yang terakhir yakni penyelenggaraan pendidikan dan Kesehatan serta secara khusus Bapak Mendagri menitipkan pesan agar pembangunan rumah sehat dan rumah layak huni bagi masyarakat Mimika yang tinggal di sekitar Pelabuhan Pomako,” pungkasnya.
Sementara itu, Wakil Bupati Mimika Johannes Rettob menerangkan pengaktifan dirinya dilakukan lantaran sebelumnya harus diberhentikan sementara lantaran menjalani proses hukum. Ia menerangkan apa yang dialami Kabupaten Mimika baru pertama kali terjadi di Indonesia bahkan mungkin di seluruh dunia.
“Sebelumnya Bupati ditersangkakan KPK, lalu masih meja peradilan dan dalam putusan pengadilan beliau bebas dan kembali diaktifkan kembali menjadi Bupati. Wakil Bupati juga begitu, ditersangkakan oleh Kejaksaan Tinggi Papua, lalu disidangkan dan dalam peradilan dinyatakan tidak bersalah serta diaktifkan kembali. Sepertinya ini hanya dialami oleh Kabupaten Mimika di seluruh daerah di dunia ini,” terangnya.
Ia berharap apa yang dialaminya menjadi edukasi bagi seluruh kepala daerah atau penyelenggara negara lainnya serta secara pribadi ini menjadi pelajaran hidup yang baik. Dalam momentum itu Johannes Rettob juga menceritakan singkat perjalanan proses hukum yang dijalaninya.
“Tahun 2017-2019 Bupati dan Wakil Bupati Mimika dilaporkan sekelompok orang ke KPK. Bupati dilaporkan tentang pembangunan gereja dan saya dilaporkan dengan kasus pengadaan pesawat dan helikopter. Pada saat ini kami berdua sedang maju Bupati dan Wakil Bupati dan tentunya dalam panggilan KPK kami berdua memenuhinya,” katanya.
“Khusus terhadap saya pada perjalanannya 2018-2019 oleh KPK dianggap tidak cukup bukti dan kasusnya diberhentikan. Kemudian tahun 2020 oleh kelompok yang lain saya dilaporkan ke Kejaksaan Tinggi Papua, tetapi pada waktu itu oleh Kejaksaan tidak boleh ditindaklanjuti karena kasusnya sudah ditangani KPK,” terangnya.
Akan tetapi, lanjut Johannes Rettob, pada tahun 2021 ia dilaporkan kembali ke Polda Papua dengan kasus yang sama, akan tetapi pada saat itu kasusnya diberhentikan. Namun pada tahun 2022 oleh sekelompok orang ia dilaporkan kembali sekaligus ke KPK, Kejaksaan dan Kepolisian serta dilaporkan ke DPRD Mimika dengan kasus yang sama.
“Oleh kepolisian kami dilaporkan melakukan pencurian dan penggelapan pesawat dan helikopter dan kasus itu kemudian di SP3 kan. Begitu juga di DPRD yang telah membuat Pansus dan menghentikan kasus ini juga. Namun oleh Kejaksaan bertindak berbeda, yakni melanjutkan kasus ini,” tuturnya.
Dalam ceritanya, Johannes Rettob menilai penyelidikan dan penyidikan yang dilakukan Kejaksaan tidak sesuai dalam kitab hukum acara pidana. Dalam proses penyidikan ia yang telah ditetapkan sebagai tersangka tidak mendapatkan haknya, yakni menghadirkan saksi-saksi yang meringankannya, melainkan langsung membawanya ke meja peradilan.
“Pelimpahan kasus saya juga tidak sesuai mekanisme yakni tanpa dilakukannya P21 atau penyerahan berkas tahap II. Memang dalam prosesnya saya tidak pernah ditahan, akan tetapi saya dicap sebagai koruptor besar yang mencuri uang negara Rp 69 miliar dari Rp 85 miliar uang untuk membeli pesawat dan helikopter,” katanya.
Dari perjalanan proses hukum yang dijalaninya sebelum ini, Johannes Rettob ingin berpesan kepada penegak hukum, untuk menegakkan hukum tanpa melanggar hukum. Sebab apa yang dialaminya itu aparat ingin menegakkan hukum tetapi dengan melanggar hukum, yang mengakibatkan ia harus dihentikan dari jabatannya sementara waktu.
“Tetapi puji Tuhan dalam proses hukum yang kami jalani, saya mengambil langkah berani, dengan menyiarkan proses hukumnya melalui media sosial, sehingga semua orang bisa melihat bagaimana saya dituntut 18 tahun 6 bulan dan membayar membayar subsider Rp 750 juta serta mengembalikan uang kerugian negara Rp 69 miliar dalam 1 bulan atau hukuman saya akan ditambahkan 9 tahun. Tetapi dengan suara hati Tuhan dan dukungan semua pihak, saya dinyatakan tidak bersalah dan bebas murni serta kini jabatan yang pernah dihentikan kembali diaktifkan,” lugasnya.
“Dan saya akan kembali menjabat Wakil Bupati Mimika serta siap menjalankan amanat yang diberikan Mendagri atau Pj Gubernur serta akan kembali hadir ditengah-tengah masyarakat,” pungkas Rettob.[*]
