Jumpa Pers Suku Moi dalam pernyataan sikap, Jumat (20/10/2023) kemarin.– Bumiofinavandu/Ist.

Sorong, Bumiofinavandu –   Koalisi Selamatkan Hutan Adat Papua bersama Masyarakat Adat Suku Moi menyatakan sikap sebagai berikut;

1. Majelis Hakim Hakim Perkara 368/G/2023/PTUN.JKT menerima Permohonan Intervensi yang dilakukan Masyarakat Adat Suku Moi dan dalam memeriksa perkara mengutamakan keadilan bagi masyarakat adat suku moi sebagai pemilik tanah dan hutan adat ;

2. Pihak Tergugat yakni BKPM melakukan tindakan lanjutan bersama lembaga pemerintahan lainnya (KHLK dan Pemerintah Daerah) segera melakukan pengakuan hutan adat masyarakat Suku Moi dengan tujuan melindungi hak-hak masyarakat ;

3. BKPM dan KLHK membuka seluruh informasi pencabutan perizinan di Tanah Papua sebagai bentuk kewajiban yang telah diatur di dalam berbagai peraturan perundang-undangan.

Pernyataan sikap tersebut disampaikan pada Jumat (20/10/2023), dalam upaya suku Suku Moi Melawan Gugatan PT. Sorong Agro Sawitindo (SAS).

Pasalnya, PT SAS sebelumnya pemegang konsesi perkebunan kelapa sawit seluas 40.000 ribu hektar yang terletak di Kabupaten Sorong, Papua Barat. Awal tahun 2022 melalui SK.01/MENLHK/SETJEN/KUM.1/1/2012 pemerintah mencabut izin pelepasan kawasan hutan yang dipegang PT SAS. BKPM kemudian mencabut izin  usaha  PT SAS melalui keputusan Nomor : 20221227-21-0006 tanggal 22 Desember 2022. Perusahaan tidak terima atas keputusan tersebut lalu mengajukan gugatan ke PTUN Jakarta dengan perkara 368/G/2023/PTUN.JKT meminta pembatalan.

Padahal, sebelumnya Bupati Sorong tahun 2021 mencabut izin lokasi, izin lingkungan dan izin usaha PT SAS, tindakan bupati ini disambut baik masyarakat Suku Moi, dalam kasus ini perusahaan menggugat dan membatalkan Keputusan Bupati.

Suku Moi adalah Orang Asli Papua yang mewarisi, menguasai dan memiliki tanah dan hutan adat sudah sejak turun temurun hingga saat ini. Keberadaan  Suku Moi telah diakui Pemerintah  melalui Peraturan Daerah (perda) Kabupaten Sorong Nomor 10 Tahun 2017 Tentang Pengakuan dan Perlindungan Masyarakat Hukum Adat Moi di Kabupaten Sorong, sebagaimana termuat dalam Pasal (2) yang berbunyi: “Dengan Peraturan Daerah ini Pemerintah Daerah Kabupaten Sorong memberikan Pengakuan dan Perlindungan hak Masyarakat Hukum Adat Moi di Kabupaten Sorong”. 

Suku Moi telah bersikap menjaga tanah dan hutan adat, mereka menolak perkebunan kelapa sawit PT Sorong Agro Sawitindo beroperasi di wilayah adatnya. Alasannya, perkebunan kelapa sawit merampas hak atas tanah dan/ hutan adat dan berpotensi menghilangkan sumber kehidupan masyarakat, dan mendatangkan malapetaka sosial dan lingkungan, sebagaimana dialami saudara mereka di daerah ini. Mereka memutuskan untuk mengelola sendiri tanah dan hutan adat di wilayah adatnya sesuai dengan pengetahuan yang dimiliki dan diwariskan secara turun temurun.


Suku Moi khawatir Gugatan PT SAS akan menghilangkan hak-hak dan mata pencaharian masyarakat yang bersumber dari hutan, tanah, sungai dan kekayaan alam sekitarnya. Mereka  memutuskan untuk melawan Gugatan PT SAS dengan mengajukan permohonan Intervensi di PTUN Jakarta.

Permohonan intervensi ini kami lakukan untuk mempertahankan hak dan kepentingan kami sebagai masyarakat adat Suku Moi. Kami ingin Majelis hakim secara hati-hati memeriksa Gugatan ini karena kami akan dirugikan jika perusahaan memenangkan gugatan ini. Hakim harus lebih memperhatikan keberadaan dan hak kami “ujar Edison Sede (masyarakat adat suku Moi dari kampung Gisim)

Saya perempuan adat suku Moi keberatan gugatan Perusahaan, kami tidak mau  kehilangan sumber penghidupan keluarga dari tanah dan hutan, kami Perempuan berkebun, mengambil sagu menjadi makanan, menjaga obat-obatan tradisional semua dari hutan. Jika Perusahaan masuk kami akan hilang. Ujar Solvina Klawom (perempuan adat suku Moi).

Ayub Paa, pendamping masyarakat adat suku Moi mengatakan Tindakan pencabutan Izin Usaha PT SAS yang dilakukan oleh BPKM sudah seharusnya dilakukan, ada banyak pelanggaran yang dilakukan.  Selain ada penolakan masyarakat juga berdampak kepada lingkungan hidup. Akan lebih tepat jika BKPM mendorong kepada instansi lain seperti KLHK dan Pemda untuk segera mengakui hutan adat masyarakat.

“Masyarakat dapat mengembangkan sendiri kehidupan ekonominya tanpa harus memfasilitasi perkebunan skala besar yang membawa dampak negatif besar,” pungkasnya.[*]
