Komisi II DPR Papua minta izin perusahaan bermasalah, DPMPTSP Papua minta waktu koordinasi, Jumat (14/10/2023). – Bumiofinavandu.

Jayapura, Bumiofinavandu –  Komisi II DPR Papua menggelar rapat kerja dalam rangka pengawasan pelaksanaan tugas dari OPD Mitra. Raker berlangsung di aula P3W Padang Bulan, kota Jayapura Jumat (13/10/2023) kemarin.

Raker dihadiri, Ketua Komisi II DPR Papua, Mega Nikijuluw, Wakil Ketua Komisi II Gerson Soma, Sekretaris Komisi II, Petrus Pigai, Anggota Komisi, Mustaqim, John NR Gobai, Kepala DPMPTSP Provinsi Papua, Kepala Dinas ESDM Provinsi Papua, Kepala Bidang Perkebunan Dinas Pertanian, Perwakilan Dinas KLHK Papua serta Direktur WALHI Papua, Direktur LBH Papua dan Koalisi Masyarakat adat yang selama ini mengadvokasi persoalan kelapa sawit dan pertambangan di Tanah Papua.

Legislator John NR Gobai melalui sambungan selulernya mengatakan, rapat tersebut digelar guna menyikapi beberapa masukan dari masyarakat adat serta aksi demonstrasi dari Koalisi masyarakat Auwyu Kabupaten Boven Digoel, Papua Selatan.

“Jadi ada aspirasi, misalnya terkait investasi kelapa sawit di daerah Papua Selatan, aspirasi masyarakat Kiura dan Iwaka, Mimika terkait PT PAL dan surat dari Suku Besar Wate di Nabire, terkait Izin tambang PT Kristalin Eka Lestari di Sungai Musairo. Raker Komisi II DPR Papua dalam rangka pengawasan pelaksanaan tugas dari OPD Mitra karena ada beberapa kasus,” ujar Gobai Jumat (13/10/2023) malam.

Dia menjelaskan bahwa dalam Raker Tersebut kasus pertama yang ditanyakan adalah terkait PT. PAL Timika, Pemda Papua mengeluarkan izin sawit bagi PT Pusaka Agro Lestari di Mimika, namun perusahaan tersebut dikabarkan mundur akibat putusan pailit oleh Pengadilan Niaga. Sementara kebun sawit sudah dibuka dan merusak lingkungan. Sehingga Pemda Papua  diminta tidak melepas tanggung jawab tetapi harus bertanggung jawab untuk mediasi masyarakat dan pengusaha.

Kasus kedua, terkait investasi sawit di Boven Digul, DPMPTSP mengeluarkan izin kepada PT. Indo Asiana Lestari dengan  Surat Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua Nomor 82 Tahun 2021, tentang Kelayakan Lingkungan Hidup Rencana Pembangunan Perkebunan Kelapa Sawit dan Pabrik Pengolahan Kelapa Sawit dengan Kapasitas 90 Ton TBS/Jam Seluas 36 094,4 Hektar oleh PT Indo Asiana Lestari di Distrik Mandobo dan Distrik Fofi Kabupaten Boven Digoel, Provinsi Papua, tertanggal 02 November 2021 telah menuai protes dari Masyarakat Adat Awyu khususnya Pemimpin Marga Woro.


“Hal ini perlu mendapat perhatian Pemprov Papua melalui OPD terkait,” jelasnya.

Kasus ketiga sambung Gobai, adalah PT. Kristalin Eka Lestari di Musairo Nabire. Dimana Dinas PMPTSP Papua, menyetujui permohonan peningkatan IUP Eksplorasi  menjadi IUP operasi produksi dengan menerbitkan izin operasi produksi nomor : 112 /IUP – OP EMAS/DPMPTSP/2020, tanggal 24 September 2020.

Sesuai Undang-Undang Nomor 3 Tahun 2020 tentang Perubahan Atas Undang-Undang Nomor 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara yang diundangkan pada tanggal 3 Juni 2020.

Terkait dengan hal tersebut salah satu ketentuan dalam pasal 173C Undang-Undang Nomor 3 Tahun 2020 adalah adanya penghentian sementara kewenangan Pemerintah Daerah di Bidang Pertambangan Mineral dan Batubara terkait penerbitan izin baru untuk jangka paling lama 6 (enam) bulan terhitung sejak Undang-Undang Nomor 3 Tahun 2020 berlaku (berlaku 10 Juni 2020).

“Padahal jika sesuai UU No 3 tahun 2020 itu, maka izin untuk PT Kristalin cacat hukum karena itu DPMPTSP harus dapat mencabut izin PT Kristalin,” sambungnya lagi.

Sehingga lanjut Gogai, Komisi II DPR Papua merekomendasikan kepada DPMPTSP agar izin-izin tersebut dicabut.

“Namun Kepala DPMPTSP Papua, Solaiyen Murib Tabuni, meminta waktu untuk berdiskusi dengan Dinas Teknis lainnya. Maka sikap kami (Komisi II) adalah atensi dari Pemerintah Provinsi Papua dan DPMPTSP Papua,” pungkasnya.[*]
