Jayapura, Bumiofinavandu –   Credit Suisse Global Wealth Databook 2019 menyatakan bahwa 1 persen orang terkaya di Indonesia menguasai 44,6 persen kekayaan nasional dan 10 persen orang terkaya di Indonesia menguasai 74,1 persen kekayaan nasional. Konsentrasi kekayaan pula yang menyebabkan tingkat pertumbuhan jangka panjang Indonesia terus melemah, yakni dari 8 persen di dekade 1970 an, menjadi 5 persen selama 2014-2020.Rangkaian draconian law tidak mencari solusi atas ketimpangan yang terjadi melainkan sebaliknya. Undang-Undang (UU) Komisi Pemberantasan Korupsi, UU Partai Politik, UU Pemilu, UU Mineral dan Batubara (Minerba), dan UU Omnibus Law Cipta Kerja menjadi potret betapa politik digunakan untuk kepentingan ekonomi para oligarki.

Tanah papua merupakan salah satu tujuan investasi menjadi “arena baru” oligarki untuk memperkaya dirinya. Salah satunya melalui berbagai penguasaan sumber daya alam di Papua, seperti perkebunan dan pertambangan.

Salah satunya adalah penerbitan Surat Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua Nomor 82 Tahun 2021 Tentang Kelayakan LIngkungan Hidup Rencana Pembangunan Perkebunan Kelapa Sawit dan Pabrik Pengolahan Kelapa Sawit Dengan Kapasitas 90 Ton TBS/Jam Seluas 36.094,4 Hektar Oleh PT Indo Asiana Lestari Di Distrik Mandobo dan Distrik Fofi Kabupaten Boven Digoel, Provinsi Papua Tertanggal 02 November 2021 telah menuai protes dari Masyarakat Adat Awyu khususnya Pemimpin Marga Woro.

Protes terhadap Surat Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua Nomor 82 Tahun 2021 kemudian diwujudkan dengan berbagai cara mulai dari melakukan aksi demonstrasi, menanamkan plang berisi Putusan MK Tentang Pengakuan Hutan Adat, Menanamkan Salib dan Bendera Meraputuh di Wilayah Adat Masyarakat Adat Awyu dan Pimpinan Marga Woro mengajukan Gugatan melawan Kepala Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Provinsi Papua di Pengadilan Tata Usaha Negara Jayapura (PTUN Jayapura) yang terdaftar dengan Register Perkara Nomor :  6 / G / LH / 2023 / PTUN.JPR.

Berkaitan Gugatan Pimpinan Marga Woro di PTUN Jayapura, Pada perkembangannya ada beberapa pihak yang melibatkan diri sebagai Gugatan Intervensi seperti Walhi Nasional dan Pusaka Bentala Rakyat yang melibatkan diri sebagai Penggugat Intervensi sementara PT.Indo Asiana Lestari sebagai Tergugat Intervensi. Sampai saat ini, proses persidangan telah memasuki fase mendengarkan pendapat ahli.

Ahli juga menjelaskan prinsip free, prior, and informed consent (FPIC) atau persetujuan awal tanpa paksaan yang merupakan hak asasi masyarakat adat. Pemerintah harus memastikan syarat ini dipenuhi sebelum memberikan izin-izin yang berdampak terhadap masyarakat adat. Pengabaian terhadap hal ini berarti pelanggaran terhadap hak masyarakat adat. Pemerintah seharusnya memasukkan instrumen FPIC ini dalam amdal, mengingat Indonesia pun telah mengadopsi kebijakan internasional untuk mengatasi krisis iklim

Berdasarkan uraian diatas maka kami, PMKRI Cabang Jayapura, HMI Cabang Jayapura, GMKI Cabang Jayapura, UKM Dehaling Univ Cenderawasih, IMPPAS, KOMPAP Papua, Sahabat Kowaki, Volunteer Greenpeace Indonesia yang tergabung dalam pernyataan sikap KOALISI PEDULI MASYARAKAT ADAT SUKU AYWU KABUPATEN BOVEN DIGOEL menyatakan sikap sebagai berikut :

1.    DPR Papua Harus menjadi lembaga independen dan lepas dari cengkraman oligarki untuk dapat  mengawasi Eksekutif Untuk Memastikan Perlindungan, pengakuan dan Penghormatan Hak-hak Masyarakat Adat;

2.    DPR Papua harus mengusulkan kebijakan dan memproduksi regulasi yang melindungi hak-hak masyarakat adat;

3.    Mendesak DPR Papua memanggil  Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua sebagai bentuk mengevaluasi terhadap kebijakan yang belum menghormati, melindungi, menegakkan dan memajukan HAK MASYARAKAT ADAT PAPUA;

4.    DPR Papua merekomendasikan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua wajib menghormati, melindungi, menegakkan dan memajukan HAK MASYARAKAT ADAT PAPUA Khususnya Masyarakat Adat SUKU AYWU (Hak Marga Woro) sesuai perintah Pasal 43, Undang Undang Nomor 2 Tahun 2021 tentang Perubahan Undang Undang Nomor 21 Tahun 2001 tentang Otonomi Khusus Bagi Provinsi Papua;

5.    Mendesak DPR Papua harus segera mendeklarasikan kondisi krisis iklim yang terjadi di Papua akibat industri ekstraktif yang menghancurkan hutan dan alam Papua;

6.    Mendesak DPR Papua wajib secara simultan membuat kebijakan  mitigasi dan adaptasi krisis iklim di Papua dan merekomendasikan kebijakan tersebut diterapkan untuk melindungi rakyat Papua khususnya generasi mendatang.[*]
