“Segera Cabut Surat Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua Nomor 82 Tahun 2021 yang Cacat Hukum dan Melanggar Hak Masyarakat Adat Papua”
Jayapura, Bumiofinavandu – Gugatan Pimpinan Marga Woro melawan Kepala Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Provinsi Papua atas penerbitan Surat Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua Nomor 82 Tahun 2021 di Pengadilan Tata Usaha Negara Jayapura (PTUN Jayapura) yang terdaftar dengan Register Perkara Nomor : 6 / G / LH / 2023 / PTUN.JPR telah memasuki agenda pembuktian. Dalam sidang pembuktian Kuasa Hukum Pimpinan Marga Woro, Pusaka Bentala Rakyat dan Walhi Nasional menghadirkan 6 (enam) orang saksi fakta sementara Kuasa Hukum Kepala Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Provinsi Papua dan PT. Indo Asiana Lestari tindak menghadirkan alat bukti saksi.
Dengan melihat Kuasa Hukum Kepala Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Provinsi Papua dan PT. Indo Asiana Lestari yang tidak menghadirkan alat bukti saksi secara langsung membuktikan bahwa penerbitan Surat Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua Nomor 82 Tahun 2021 terdapat kejanggalan dalam prosesnya. Fakta kejanggalan dalam penerbitan kebijakan tersebut terlihat jelas dalam keterangan 6 (enam) orang saksi fakta yang dihadirkan oleh Kuasa Hukum Pimpinan Marga Woro, Pusaka Bentala Rakyat dan Walhi Nasional sebagai berikut :
Pertama fakta “tidak adanya ruang sosialisasi yang dialogis dan bahkan dalam mediasi antara perusahaan dengan masyarakat menolak perusahaan dilakukan dengan cara-cara intimidatif didepan mata pihak keamanan dan pemerintahan DIstrik”. Fakta tersebut terungkap dalam keterangan Saksi KASIMILUS AWE mengatakan bahwa saksi ikut dalam pertemuan yang diselenggarakan di Rumahnya Fabianus Senfahagi selaku Kepala Satuan Polisi Pamong Praja (Satpol PP) Kabupaten Boven Digoel dimana dalam pertemuan itu saksi diminta untuk datang, duduk, dengar dan pulang.
Selanjutnya saksi juga mengatakan bahwa sebagai jawaban dari Aksi Demonstrasi ke DPRD, Bupati dan Kantor PMPTSP Kab Boven selanjutnya di gelas medias. Proses mediasi permasalahan penolakan perusahaan PT Indo Asiana Lestari (IAL), pihak pemerintah Kepala Distrik Fofi minta difasilitasi Kepolisian Resor (Polres) Boven Digoel dan berlangsung di Kantor Polres. Kasmilus menjelaskan dalam pertemuan “Mediasi di Kantor Sentra Pelayanan Kepolisian Terpadu atau SPKT Polres Boven Digoel pada 16 November 2020.
Saat itu, Kepala distrik mengajak masyarakat yang pro perusahan hadir dengan membawa alat tajam, berdiri di depan SKPT. Saya hadir bersama kepala suku dijemput oleh polisi. Saat saya bicara, saya diminta untuk berhenti berbicara. Ada suara bentakan dari masyarakat yang pro perusahan. Pihak kepolisian dan kepala distrik meminta kami menandatangani surat persetujuan menerima perusahaan. Kepala Suku Awyu Igedinus Pius Suam menandatangani karena dalam situasi tekanan, ada ancaman”.
Fakta tersebut secara langsung bertentangan dengan ketentuan “Masyarakat yang terkena dampak langsung sebagaimana dimaksud pada ayat (1) berhak mengajukan saran, pendapat, dan tanggapan terhadap rencana Usaha dan/atau Kegiatan dalam jangka waktu 10 (sepuluh) hari kerja sejak pengumuman sebagaimana dimaksud pada ayat (2) huruf a. Saran, pendapat, dari tanggapan sebagaimana dimaksud pada ayat (3) disampaikan secara tertulis kepada penanggung jawab Usaha dan/atau Kegiatan” sebagaimana diatur pada Pasal 28 ayat (3) dan ayat (4), Peraturan Pemerintah Nomor 22 Tahun 2021 Tentang Penyelenggaraan Perlindungan Dan Pengelolaan Lingkungan Hidup.
Kedua fakta “Masyarakat tidak perna mendengar surat izin kelayakan lingkungan hidup yang diterbitkan oleh DPMPTSP Papua dan masyarakat adat awyu tidak melepaskan tanah untuk perusahaan serta masyarakat adat awyu tidak pernah memberi kuasa kepada Ketua Lembaga Masyarakat Adat Boven Digoel Fabianus Senfahagi untuk mewakili masyarakat adat Awyu untuk mendatangkan [kesepakatan dengan] PT Indo Asiana Lestari dan tindak diundang dalam konsultasi publik”. Fakta tersebut terungkap melalui keterangan Saksi YUSTINUS BUNG yang mengatakan bahwa “Saya tidak pernah mendengar surat izin kelayakan lingkungan hidup yang diterbitkan oleh DPMPTSP Papua. Hal itu, tidak pernah disampaikan. Saya tidak pernah diundang konsultasi publik terkait kehadiran perusahaan”.
Ia menegaskan masyarakat adat tidak pernah melepaskan tanah untuk perusahan sawit PT IAL. Menurut Bung, masyarakat adat “[Kami] tidak pernah memberi kuasa kepada Ketua Lembaga Masyarakat Adat Boven Digoel Fabianus Senfahagi untuk mewakili masyarakat adat Awyu untuk mendatangkan [kesepakatan dengan] PT Indo Asiana Lestari. Kalau hendak melepaskan tanah adat, kami [marga-marga] harus kumpul bersepakat tanah itu dijual atau tidak”.
Bung menyatakan masyarakat adat sangat menolak kehadiran PT IAL. Ia khawatir kehadiran perusahaan perkebunan kelapa sawit itu akan menghancurkan sumber kehidupan masyarakat adat dan lokasi-lokasi keramat serta sumber obat tradisional mereka. Fakta tersebut secara langsung bertentangan dengan ketentuan “Penanggung jawab Usaha dan/atau Kegiatan dalam menyusun Amdal sebagaimana dimaksud dalam pasal 21 ayat (1) melibatkan masyarakat yang terkena dampak langsung. Pelibatan masyarakat yang terkena dampak langsung sebagaimana dimaksud pada ayat (l) dilakukan melalui: a. pengumuman rencana Usaha dan/atau Kegiatan; dan b. konsultasi publik” sebagaimana diatur pada Pasal 28 ayat (1) dan ayat (2), Peraturan Pemerintah Nomor 22 Tahun 2021 Tentang Penyelenggaraan Perlindungan Dan Pengelolaan Lingkungan Hidup dan ketentuan “Perundingan yang dilakukan antara Pemerintah Provinsi, Kabupaten/Kota, dan penanam modal harus melibatkan masyarakat adat setempat” sebagaimana diatur pada Pasal 42 ayat (3), Undang Undang Nomor 2 Tahun 2021 tentang Perubahan Undang Undang Nomor 21 Tahun 2001 tentang Otonomi Khusus Bagi Provinsi Papua.
Ketiga fakta “penolakan dari masyarakat adat awyu serta intimidasi dari masyarakat pro terhadap masyarakat yang tolah dan penandatanganan yang dilakukan atas inisiatif pribadi tanpa ada kesepakatan dalam marga yang melahirkan ketidakharmonisan dalam keluarga akibat kehadiran perusahaan”. Fakta tersebut terungkap melalui keterangan Saksi RIKARDA MAA yang menjelaskan bahwa PT IAL pernah melakukan sosialisasi kepada masyarakat di Kampung Ampera, Distrik Mandobo, Kabupaten Boven Digoel pada 19 Agustus 2017. “Saya hadir saat itu. Sosialisasi di Balai kampung Ampera, Mereka bicara perusahaan [akan menyediakan] air bersih, pendidikan, dan [bangun] perumahan rakyat,” ujar Maa menirukan janji manajemen PT IAL dalam pertemuan itu.. “Saat sosialisasi perusahaan itu, saya [bersama] bapak saya [dan] saudara saya, dan bapak Hendrikus Woro menolak kehadiran perusahan. [Tetapi] Kepala Satpol PP membentak bapak saya dan Hendrikus Woro. Ada tekanan dari Pace Fabianus [kepada] masyarakat untuk menerima perusahaan. Rikarda Maa mengatakan “Bapak adek Yulianus Maa tanda tangan sendiri sebagai pribadi [yang] menerima perusahaan. Tidak pernah ada musyawarah marga terkait [menerima] kehadiran perusahaan [itu]”.
“Kami punya tanah cuma sepenggal, tidak besar. Kalau jual kami tidak ada tempat makan. Kami tetap mempertahankan [tanah adat kami] walaupun bapak ade sudah tandatangan menerima perusahan”. Menurut Maa kehadiran perusahaan ini membuat hubungan keluarga juga tidak harmonis. Fakta tersebut secara langsung menunjukan pelanggaran ketentuan “Masyarakat yang terkena dampak langsung memberikan saran, pendapat, dan tanggapan terhadap rencana Usaha dan/atau Kegiatan pada konsultasi publik sebagaimana dimaksud pada ayat (2) huruf b.
Saran, pendapat, dan tanggapan terhadap rencana usaha dan/atau Kegiatan pada konsultasi publik sebagaimana dimaksud pada ayat (5) dicatat dalam berita acara konsultasi publik” sebagaimana diatur pada Pasal 28 ayat (5) dan ayat (6), Peraturan Pemerintah Nomor 22 Tahun 2021 Tentang Penyelenggaraan Perlindungan Dan Pengelolaan Lingkungan Hidup.
Keempat fakta “adanya Wilayah Adat milik Marga Woro seluas 2.014 hektare yang diberikan pemerintah secara sepihak kedalam 36.094,4 hektar kepada PT Indo Asiana Lestari”. Fakta tersebut terungkap dalam keterangan Saksi ARIEF ROSSI yang adalah tenaga ahli yang membuat Peta Wilayah Adat Marga Woro berdasarkan pendekatan Pemetaan Partisan mengatakan bahwa “Kami memandu masyarakat membuat peta sketsa [yang] digunakan untuk melakukan survei tempat penting dan batas-batas wilayah. Setelah peta sketsa dibuat, kami membentuk tim untuk melakukan pemetaan, mengambil titik koordinat [di batas adat seperti] di kali, sungai, hutan dan tempat penting lainnya”. Menurut Arief, semua data titik koordinat yang diambil sesuai arahan masyarakat adat marga Woro itu kemudian diolah secara digital melalui aplikasi ArcGIS. Hasil pengolahan itu menunjukkan peta lahan masyarakat adat marga Woro tumpang tindih dengan lahan konsesi perusahaan PT Indo Asiana Lestari. Luasan lahan yang tumpang tindih itu mencapai 2.014 hektare. “Lahan warga Woro di-overlay atau tumpang susun lahan konsesi perusahaan. [Ada tumpang tindih] 2.014 hektare lahan adat masyarakat adat Woro dengan [konsesi] PT IAL”. Berdasarkan keterangan diatas serta tidak dilibatkannya Yayasan Pusaka Bentala Rakyat atau Arif Rossy sebagai pribadi dalam Sosialisasi maupun Konsultasi untuk meminta kejelasan wilayah adat marga woro maka secara langsung menunjukan adanya dugaan pelanggaran ketentuan “Pemerhati Lingkungan hidup, peneliti, atau lembaga swadaya masyarakat pendamping yang telah membina dan/atau mendampingi masyarakat terkena dampak langsung sebagaimana dimaksud pada ayat (1) dapat dilibatkan sebagai bagian dari masyarakat yang terkena dampak langsung” sebagaimana diatur pada Pasal 29 ayat (2), Peraturan Pemerintah Nomor 22 Tahun 2021 Tentang Penyelenggaraan Perlindungan Dan Pengelolaan Lingkungan Hidup serta melalui fakta 2.014 hektar tanah adat marga woro yang masuk kedalam konsesi PT. Indo Asiana Lestari maka jelas-jelas menunjukan fakta dugaan “Tindak Pidana Penggelapan Tanah Adat” sebagaimana diatur pada Pasal 385 KUHP.
Kelima fakta “Tidak Pernah ada sosialisasi di Kampung Yare serta Hendrikus Woro sebagai Pemimpin Marga Woro yang menerima kuasa dari seluruh marga woro untuk melakukan gugatan TUN terhadap izin kelayakan lingkungan yang diterbitkan DPMPTSP Papua kepada PT IAL. Dalam rangka penolakan Marga Woro bersama Masyarakat awyu telah melakukan upacara adat penancapan salib atau patok adat di lokasi hak ulayat masyarakat adat, sebagai bentuk penolakan terhadap PT IAL”. Fakta tersebut terungkap dalam keterangan Saksi TADIUS WORO mengatakan Tidak pernah ada sosialisasi akan kehadiran perusahan. Tidak ada pertemuan apapun terkait kehadiran perusahan, baik dari perusahaan, maupun pemerintah di Kampung Yare. Marga Woro telah melakukan musyawara adat dan mengukuhkan Hendrikus Woro sebagai Pemimpin Marga Woro dan memberikan kuasa kepada Hendrikus Woro untuk melakukan gugatan TUN terhadap izin kelayakan lingkungan yang diterbitkan DPMPTSP Papua kepada PT IAL. Ia juga bersaksi bahwa masyarakat adat sudah melakukan upacara adat penancapan salib atau patok adat di lokasi hak ulayat masyarakat adat, sebagai bentuk penolakan terhadap PT IAL. Woro mengatakan tanah dan hutan merupakan warisan leluhur Suku Awyu yang harus dijaga, dilindungi dan dirawat. “Kegiatan berburu babi, memancing, pangkur sagu. Kami hidup dari alam. Jadi kami tidak bisa kasih [tanah] kepada perusahaan. Saya tidak bisa kasih hutang ke perusahaan. Saya hidup dari hutan”.
Pada prinsipnya melalui keterangan diatas sudah dapat menunjukan adanya dugaan pelanggaran ketentuan “Masyarakat yang terkena dampak langsung yang dilibatkan dalam penyusunan Amdal sebagaimana dimaksud dalam Pasal 28 ayat (l) merupakan masyarakat yang berada di dalam batas wilayah studi Amdal yang akan terkena dampak secara langsung baik positif dan/atau negatif dari adanya rencana Usaha dan/atau Kegiatan” sebagaimana diatur pada Pasal 29 ayat (1), Peraturan Pemerintah Nomor 22 Tahun 2021 Tentang Penyelenggaraan Perlindungan Dan Pengelolaan Lingkungan Hidup dan dugaan pelanggaran Hak Masyarakat Adat Papua yang dijamin pada Pasal 18b ayat (2), UUD 1945 juncto Pasal 6 UU Nomor 39 Tahun 1999 tentang Hak Asasi Manusia junto Pasal 43, Undang Undang Nomor 2 Tahun 2021 tentang Perubahan Undang Undang Nomor 21 Tahun 2001 tentang Otonomi Khusus Bagi Provinsi Papua.
Keenam Faktanya “masyarakat adat Suku Awyu sangat bergantung terhadap hutan dan tanah. Bahkan masyarakat adat dapat menyekolahkan anaknya hingga ke jenjang perguruan tinggi dari hasil hutan”. Fakta itu terungkap dalam keterangan Saksi ANTONIA NOYAGI mengatakan kehidupan masyarakat adat Suku Awyu sangat bergantung terhadap hutan dan tanah. “Biasa berkegiatan di hutan pangkur sagu, berburu, memancing, dan cari kayu gaharu. [Saya] cari kayu gaharu untuk biaya pendidikan anak-anak, menjualnya ke kios-kios terapung. [Saya] punya anak sembilan, ada yang sudah tamat SMA, sudah jadi tentara, dan ada yang kuliah di Jakarta. Mama sendiri yang biaya,”. Noyagi juga mengatakan “[Kami] tidak menerima kehadiran perusahan sawit. Bahwa melalui diterbitkannya Surat Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua Nomor 82 Tahun 2021 bertentangan dengan ketentuan “hutan adat adalah hutan yang berada dalam wilayah masyarakat hukum adat” sebagaimana diatur dalam Putusan Perkara Mahkama Konstitusi Nomor : 35/PUU-X/2012 Tentang “Tanah Hak ulayat Masyarakat Hukum Adat dan bertentangan dengan Pasal 43, Undang Undang Nomor 2 Tahun 2021 tentang Perubahan Undang Undang Nomor 21 Tahun 2001 tentang Otonomi Khusus Bagi Provinsi Papua.
Berdasarkan keterangan 6 (enam) orang saksi fakta yang dihadirkan oleh Kuasa Hukum Pimpinan Marga Woro, Pusaka Bentala Rakyat dan Walhi Nasional dan dugaan temuan pelanggaran peraturan perundang-undangan di atas sudah dapat menunjukan bahwa Proses penerbitan Surat Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua Nomor 82 Tahun 2021 Tentang Kelayakan Lingkungan Hidup Rencana Pembangunan Perkebunan Kelapa Sawit dan Pabrik Pengolahan Kelapa Sawit Dengan Kapasitas 90 Ton TBS/Jam Seluas 36.094,4 Hektar Oleh PT Indo Asiana Lestari Di Distrik Mandobo dan Distrik Fofi Kabupaten Boven Digoel, Provinsi Papua Tertanggal 02 November 2021 dilakukan secara janggal sebab bertentangan dengan ketentuan Undang Undang Nomor 2 Tahun 2021 tentang Perubahan Undang Undang Nomor 21 Tahun 2001 tentang Otonomi Khusus Bagi Provinsi Papua, Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, Peraturan Pemerintah Nomor 27 tahun 2012 tentang Izin Lingkungan dan Peraturan Menteri Lingkungan Hidup Nomor 8 tahun 2013 tentang Tata Laksana Penilaian dan Pemeriksaan Dokumen Lingkungan Hidup Serta Penerbitan Izin Lingkungan. Melalui kejanggalan tersebut secara langsung menunjukan fakta pelanggaran salah asas administrasi pemerintahan yaitu “Asas kepastian hukum” dimana “asas dalam negara hukum yang mengutamakan landasan ketentuan peraturan perundang-undangan, kepatutan, keajegan, dan keadilan dalam setiap kebijakan penyelenggaraan pemerintahan” sebagaimana diatur pada penjelasan pasal 10 ayat (1) Undang-Undang Nomor 30 tahun 2014 tentang Administrasi Pemerintahan.
Berdasarkan keterangan Saksi Fakta, Dugaan Pelanggaran Hukum dan Kesimpulan Pelanggaran Asas kepastian hukum” di atas jika dikontekstualkan dengan ketentuan “Izin lingkungan sebagaimana dimaksud dalam Pasal 36 ayat (4) dapat dibatalkan apabila : a.
persyaratan yang diajukan dalam permohonan izin mengandung cacat hukum, kekeliruan, penyalahgunaan, serta ketidakbenaran dan/atau pemalsuan data, dokumen, dan/atau informasi” serta “izin lingkungan dapat dibatalkan melalui putusan pengadilan tata usaha Negara” sebagaimana diatur pada Pasal 37 ayat 2 huruf a dan Pasal 38, Undang-undang Nomor 32 tahun 2009 tentang Perlindungan Dan Pengelolaan Lingkungan Hidup maka sudah semestinya SURAT KEPUTUSAN KEPALA DINAS PENANAMAN MODAL DAN PELAYANAN TERPADU SATU PINTU PROVINSI PAPUA NOMOR 82 TAHUN 2021 DICABUT KARENA CACAT HUKUM DAN MELANGGAR KETENTUAN HOKUM LAINNYA KHUSUSNYA YANG BERKAITAN DENGAN PERLINDUNGAN HAK MASYARAKAT ADAT PAPUA. Dalam rangka melindungi Hak Masyarakat Adat Papua dijamin pada Pasal 43, Undang Undang Nomor 2 Tahun 2021 tentang Perubahan Undang Undang Nomor 21 Tahun 2001 sehingga kami Lembaga Bantuan Hukum Papua menegaskan kepada :
1. Presiden Republik Indonesia segera perintahkan Menteri Lingkungan Hidup dan Kehutanan Republik Indonesia untuk mencabut semua ijin yang mengorbankan Hak Masyarakat Adat Papua yang dijamin pada Pasal 43, Undang Undang Nomor 2 Tahun 2021 tentang Perubahan Undang Undang Nomor 21 Tahun 2001 sesuai perintah Pasal 37 ayat 2 huruf a, Undang-undang Nomor 32 tahun 2009;
2. Gubernur Provinsi Papua segera perintah Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua segera cabut semua izin yang mengorbankan Hak Masyarakat Adat Papua yang dijamin pada Pasal 43, Undang Undang Nomor 2 Tahun 2021 tentang Perubahan Undang Undang Nomor 21 Tahun 2001 sesuai perintah Pasal 37 ayat 2 huruf a, Undang-undang Nomor 32 tahun 2009;
3. Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua segera cabut Surat Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua Nomor 82 Tahun 2021 cacat hukum sesuai perintah Pasal 37 ayat 2 huruf a, Undang-undang Nomor 32 tahun 2009;
4. Majelis Hakim Pemeriksa Perkara Nomor : 6 / G / LH / 2023 / PTUN.JPR mencabut Surat Keputusan Kepala Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu Provinsi Papua Nomor 82 Tahun 2021 sesuai perintah Pasal Pasal 38, Undang-undang Nomor 32 tahun 2009.[*]
