Sidang Gugatan Lingkungan Hidup, Saksi; Izin Lingkungan PT IAL tidak melibatkan Warga dari Marga Woro dan Suku Awyu

Nabire, Bumiofinavandu –  Persidangan gugatan yang diajukan pejuang lingkungan hidup dari suku Awyu, Hendrikus ‘Franky’ Woro, di Pengadilan Tata Usaha Negara Jayapura telah, memasuki tahap mendengar keterangan saksi. Franky sebelumnya menggugat izin kelayakan lingkungan hidup yang dikeluarkan Dinas Penanaman Modal dan Pelayanan Terbuka Satu Pintu (DPMPTSP) Provinsi Papua untuk perusahaan sawit PT Indo Asiana Lestari (PT IAL).

Melalui rilis yang diterima bumiofinavandu.com, dalam sidang gugatan Lingkungan Hidup yang berlangsung di Pengadilan Negeri Jayapura pada Kamis (27/07/2023) kemarin, saksi mengungkapkan fakta baru bahwa izin lingkungan PT IAL tidak melibatkan warga dari Marga Woro dan Suku Awyu.

Setidaknya ada dua orang saksi yang hadir dari Boven Digoel pada persidangan kali ini yaitu, Arief Rossi Ramadhan ahli pemetaan partisipatif dari Yayasan Pusaka Bentala Rakyat serta Kasimus Awe, perwakilan masyarakat adat suku Awyu.

Arief Rossi Ramadhan menjelaskan, proses pemetaan partisipatif untuk keperluan inventarisasi keanekaragaman hayati, dan untuk pengakuan wilayah adat harus diajukan ke Bupati, yang dilakukan marga Woro.

Sementara Kasimus Awe, perwakilan masyarakat adat suku Awyu,  menjelaskan adanya tekanan pada proses sosialisasi dan mediasi.

Lalu dalam persidangan sebelumnya pada 6 Juli lalu, kuasa hukum masyarakat Awyu mengajukan 50 dokumen dalam sidang pembuktian. Berkas-berkas tersebut membuktikan terjadinya kesalahan Pemerintah Provinsi Papua dalam menerbitkan izin lingkungan hidup untuk PT IAL yang tak mengindahkan hak-hak masyarakat adat dan ancaman krisis iklim saat ini.

Adapun Pemerintah Provinsi Papua dan PT IAL masing-masing mengajukan 29 dan 36 dokumen bukti mereka–beberapa di antaranya sama–pada persidangan 13 Juli 2023.

Kuasa hukum masyarakat Awyu mencatat, sejumlah bukti yang diajukan PT IAL justru menunjukkan bahwa masyarakat marga Woro tak dilibatkan dan menjadi korban dalam proses pengurusan izin lingkungan perusahaan sawit tersebut.

Misalnya, tanah adat marga Woro disebut sebagai milik marga lain dalam peta marga yang diajukan PT IAL. Selain itu, PT IAL berdalih telah mengumumkan rencana aktivitas perusahaan lewat media cetak Harian Papua.

Padahal, persebaran koran tersebut tak sampai tempat domisili marga Woro. Kantor media cetak itu pun sudah cukup lama tak beroperasi dan halaman webnya sudah tak diperbaharui lagi.

Aliansi Mahasiswa dan Pemuda Peduli Hutan dan Hak Masyarakat Adat (AMPERA MADA) Papua, juga memberikan dukungan dari luar persidangan. Mereka (AMPERA MADA) menggelar aksi damai dengan membentangkan spanduk bertuliskan “Save Indigenous Papuans’ Forest”, “Cabut Semua Izin di Tanah Awyu” dan “Segera Cabut SK Kepala Dinas PMPTSP Provinsi Papua No 82 Tahun 2021 tentang Kelayakan Lingkungan Hidup.[*]
