Nabire, Bumiofinavandu –  Terungkapnya Pemalsuan 21 IUP Operasi Produksi Perusahan Tambang Emas di Kalimantan Timur (KALTIM POST 24 Juni 2022), menunjukan begitu beraninya pelaku usaha melakukan kejahatan dengan memanipulasi dokumen perizinan. Agar bisa melakukan aktifitas penambangan tanpa melalui Prosedur perizinan resmi yang telah ditetapkan  oleh Negara melalui Undang-undang pertambangan.

Atas pemalsuan IUP Operasi Produksi ini, Gubernur Kalimantan Timur  telah mengambil langkah-langkah konkrit dengan meminta Dinas ESDM Provinsi dan Dinas DPMPTSP setempat, agar segera melakukan klarifikasi dan upaya  penegakan hukum.

Fenomena yang sama terjadi juga di Kabupaten Nabire Provinsi Papua Tengah. Saat ini, terdapat IUP Tambang yang dipastikan tidak terdaftar dalam Register buku Penomoran surat keluar pada Bagian Umum / SUB TU Tahun 2010.

Kesimpulan ini didasarkan pada hasil pemeriksaan keabsahan Surat Usaha Tambang yang dilakukan oleh Bupati Nabire Tahun 2023.

Kata Terdaftar menurut pengertian di dalam KBBI didefinisikan sebagai sudah tercatat (tercantum , dimasukan) dalam daftar.   

secara etimologi kata “tidak terdaftar “ dapat diartikan sebagai Tidak  tercatat (tercantum, dimasukan) dalam daftar dan atau dapat diartikan bahwa dokumen tidak terdaftar adalah dokumen yang tidak diproses. tidak tercantum dan tidak dimasukan secara resmi dan atau tidak melewati Prosedur resmi  di dalam  tata Kelola administrasi pemerintahan.

IUP adalah Produk Hukum yang tata cara  permohonan , persyaratan dan persetujuannya telah diatur didalam Undang-undang dan Peraturan Pemerintah. Sehingga sangatlah Tidak Masuk Akal Jika ada IUP yang dikeluarkan oleh Pemerintah tetapi  tidak  tercatat dalam sistem Penomoran surat baik dalam register penomoran surat masuk terkait surat Permohonannya maupun didalam register surat keluar terkait pengesahan IUP nya.

Kesimpulan yang dapat diambil terhadap status tidak terdaftar IUP Eksplorasi No : 543/175/SET tanggal 19 Mei 2010 yang dimiliki oleh PT. Kristalin Ekalestari  adalah bahwa  IUP tersebut BUKAN merupakan Produk Hukum Resmi yang dikeluarkan oleh Pemerintah Kabupaten Nabire , dan atau  IUP Eksplorasi tersebut dapat  dikategorikan sebagai   dokumen Palsu.

Hal ini patut disayangkan karena Pihak perusahaan telah menggunakan Dokumen IUP Eksplorasi ini didalam berkas Gugatannya terhadap Gubernur Papua di Ombudsman Republik Indonesia dengan nomor Register :0141/L.M/IV/2018/JKT  , IUP Eksplorasi yang sama juga telah dijadikan dasar dalam mengajukan Permohonan Peningkatan IUP Eksplorasi menjadi IUP Operasi Produksi di Dinas DPMPTSP Provinsi Papua  dan  telah  mendapatkan persetujuan dengan diterbitkannya IUP Operasi Produksi nomor : 112/IUP-OP EMAS/DPMPTSP/2020 tanggal 24 September yang ditanda-tangani oleh Kadis PTSP Jhoni Wai S.Hut. M.Si yang pada saat itu sudah tidak lagi menjabat sebagai Kepala dinas PTSP.

Dengan dikeluarkannya Surat keterangan Bupati Nabire Nomor : 543/698/SET , tanggal 01 Maret 2023 , sebagai Fakta Baru , maka Ombudsman Republik Indonesia Wajib Melakukan Tindakan Korektif terhadap Legal Standing PT. Kristalin Ekalestari  dalam Gugatannya terhadap Gubernur Papua khusus yang mendalilkan  IUP Eksplorasi 543/175/SET tanggal 19 Mei 2010 sebagai dasar Gugatannya dan Tindakan  korektif  harus dilakukan  juga terhadap Rekomendasi didalam LAHP .Hal ini menjadi sangat penting agar marwah dan martabat Ombudsman Republik Indonesia sebagai Lembaga Negara dapat ditegakkan.

Surat Bupati Nabire Nomor : 543/698/SET , tanggal 01 Maret 2023  , dapat juga dijadikan dasar oleh  Gubernur Papua untuk  meminta Klarifikasi dan keterangan dari Dinas DPMPTSP dan Dinas ESDM Provinsi Papua terkait diterbitkannya  IUP Operasi Produksi nomor: 112 / IUP – OP EMAS / DPMPTSP/2020 , karena IUP Operasi Produksi  tersebut dimohonkan dengan menggunakan IUP Palsu.

Pemalsuan adalah  Murni Pelanggaran Hukum sebagaimana dimaksud di dalam KUH Pidana Pasal 263 ayat 1 dengan ancaman Pidana Penjara selama 6 tahun dan terhadap Pihak yang menggunakan Dokumen Palsu  tersebut diancam dengan pidana yang sama , pasal 263 : 2 .

Terkait IUP Eksplorasi Nomor : 543/175/SET  bahwa Surat Keterangan  Bupati Nabire Nomor : 543/698/SET , tanggal 01 Maret 2023 telah memenuhi ketentuan  pasal 263 (ayat) 1 dan Laporan Ke Ombudsman  Republik Indonesia dengan Nomor Registrasi :0141/LM/IV/2018/JKT dan Surat Permohonan nomor : 025.A/KE -XII/2019 tanggal 9 Desember 2019 tentang permohonan peningkatan IUP Eksplorasi menjadi IUP Operasi Produksi  telah memenuhi ketentuan Pasal 263 (ayat) 2 . dan atau unsur Pemalsuan dan Penggunaan dokumen palsu telah terpenuhi .

Pengelolaan kekayaan alam harus dapat memberikan manfaat kepada Negara dan Masyarakat demi terciptanya tata Kelola usaha yang sehat dengan tetap mengikuti seluruh ketentuan Hukum sektor pertambangan dan ketentuan Hukum lainnya yang berkaitan dengan kegiatan dimaksud , karena  Untuk  tujuan dan alasan apapun baik itu alasan kemanusiaan dan alasan-alasan lainnya kegiatan Penambangan tidak boleh dilakukan dengan melanggar Hukum.

Bahwa Locus Delicti pemalsuan dan penambangan dengan menggunakan izin palsu terjadi di Nabire  , maka Sudah saatnya Aparat penegak hukum di kabupaten Nabire  melakukan penyelidikan terhadap semua Pihak terkait pemalsuan dokumen dan kegiatan penambangannya ,  dan karena  Pemalsuan bukan merupakan delik aduan , maka  diharapkan Langkah-langkah  kongkrit harus segera diambil , sehingga tidak muncul kesan di masyarakat bahwa  pelanggaran hukum seperti ini pasti  akan diabaikan karena sarat dengan  kepentingan di dalamnya.[*]
