Nabire, Bumiofinavandu – Direktur Eksekutif Lembaga Penelitian, Pengkajian dan Pengembangan Bantuan Hukum (LP3BH) Manokwari mendesak Jaksa Agung Republik Indonesia melalui Kepala Kejaksaan Tinggi (Kajati) Papua Barat untuk melakukan inspeksi terhadap Kepala Kejaksaan Negeri (Kajari) Manokwari dalam memberi prioritas kepada putra putri Asli Papua yang berstatus pejabat dan jaksa fungsional untuk juga mendapat kesempatan pertama dan utama dalam menjalani tugas di lingkungan Kejaksaan Negeri (Kejari) Manokwari.
Hak ini disampaikan berdasarkan amanat pasal 62 ayat (2) Undang Undang Nomor 21 Tahun 2001 Tentang Otonomi Khusus Bagi Provinsi Papua yang mengamanatkan : “Orang Asli Papua berhak memperoleh kesempatan dan diutamakan untuk mendapatkan pekerjaan dalam semua bidang pekerjaan di wilayah Provinsi Papua (i.c.Papua Barat) berdasarkan pendidikan dan keahliannya”.
Di dalam penjelasan pasal 62 ayat (2) disebutkan bawa pengutamaan kesempatan untuk mendapatkan pekerjaan bagi orang asli Papua merupakan suatu langkah afirmatif dalam rangka pemberdayaan di bidang ketenagakerjaan.
Sehingga menurut pandangan hukum saya bahwa jabatan-jabatan utama seperti Kepala Seksi (Kasi) di lingkungan Kejari Manokwari sebagai Kejari Kelas I seharusnya sudah saatnya diberikan kepercayaa untuk diduduki oleh anak-anak asli Papua berstatus Jaksa dan pejabat.
Apalagi jika jaksa atau pejabat tersebut pernah mengenyam karier sebagai pegawai negeri di lingkungan Kejaksaan Agung Republik Indonesia. Sehingga sejalan dengan tujuan awal perekrutan tenaga atau calon tenaga jaksa berstatus OAP di Tanah Papua.
Pemberian kesempatan kepada OAP untuk mengenyam karier di Tanah Papua, termasuk Kejari Manokwari akannjauh lebih elok dari pada memutasikan pegawai kejaksaan yang mungkin bermasalah untuj menduduki jabatan tertentu disini yang seringkali bisa menimbulkan dampak buruk bagi kinerja sesama abdi hukum di lembaga kejaksaan yang terhormat ini. Sebagai sesama pejabat penegak hukum berdasarkan amanat Pasal 5 ayat (2) UU RI No.18 Tahun 2003 Tentang Advokat, saya cenderung memandang bahwa pimpinan Kejati Papua Barat harus memberi ruang lebih banyak bagi jaksa OAP untuj terlibat dalam upaya penegakan hukum dengan menduduki jabatan fungsional di lingkungan seksi barang bukti, penyidikan tindak pidana umum, tindak pidana narkoba, tindak pidana korupsi dan intelijen kejaksaan. Baik di lingkungan Kejati Papua Barat maupun kejaksaan negeri Manokwari, Sorong, Fakfak, Kaiman dan Teluk Bintuni.(*)
